1. Agreement to Terms

By accessing or using fAIk.life ("the Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not access or use the Platform.

These Terms constitute a legally binding agreement between you ("User", "you", or "your") and fAIk.life. Your continued use of the Platform following any updates to these Terms constitutes acceptance of those changes.

2. Description of Service

fAIk.life is a subscription-based platform providing access to an AI Model Profile Platform where creators can showcase their work and interact with fans. The specific tools and features available to you depend on your subscription tier.

We reserve the right to modify, add, or remove tools and features at any time, with or without notice. We will endeavour to provide reasonable notice of significant changes.

3. Eligibility

You must be at least 18 years of age to use the Platform. By agreeing to these Terms, you represent and warrant that:

  • You are at least 18 years old.
  • You have the legal capacity to enter into a binding agreement.
  • You are not prohibited from using the Services under any applicable law.
  • Your use of the Platform will not violate any applicable laws or regulations.

4. Account Registration

4.1 Account Creation

To access the Services, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep this information up to date.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

  • Choose a strong, unique password.
  • Not share your account credentials with any third party.
  • Notify us immediately at support@faik.life if you suspect any unauthorised access to your account.

We are not liable for any loss or damage arising from your failure to maintain account security.

4.3 Account Termination

We reserve the right to suspend or terminate your account at our discretion if you breach these Terms or engage in conduct we deem harmful to other users or the Platform.

5. Subscriptions and Billing

5.1 Subscription Plans

Access to the Platform requires a paid subscription. Details of available plans, including pricing and included features, are available at fAIk.life/pricing. Subscription fees are charged in advance on a recurring basis (monthly or annually, depending on your chosen plan).

5.2 Payment

By subscribing, you authorise us to charge your nominated payment method for the applicable subscription fee. All fees are exclusive of taxes unless stated otherwise. You are responsible for any applicable taxes.

5.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You can manage or cancel your subscription from your account dashboard.

5.4 Price Changes

We may change our subscription prices with at least 30 days' notice. Price changes take effect at your next renewal date. Continued use of the Platform after a price change constitutes acceptance of the new pricing.

5.5 Failed Payments

If a payment fails, we may suspend your access to the Platform until payment is resolved. We will notify you of any payment failure and provide a reasonable opportunity to update your payment details.

6. Acceptable Use

Your use of the Platform is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. By using the Platform, you agree to comply with the Acceptable Use Policy at all times.

7. AI-Generated Content

7.1 Nature of AI Outputs

The Platform uses artificial intelligence to generate content, suggestions, analyses, and other outputs ("AI Outputs"). AI Outputs are provided for general informational and utility purposes only.

7.2 No Professional Advice

AI Outputs do not constitute legal, financial, medical, psychological, or any other form of professional advice. You should not rely on AI Outputs as a substitute for qualified professional advice. Always seek independent professional guidance for decisions with significant consequences.

7.3 Accuracy

AI Outputs may contain errors, inaccuracies, or outdated information. We do not warrant the accuracy, completeness, or fitness for purpose of any AI Output. You assume full responsibility for how you use AI Outputs.

7.4 Your Content

You retain ownership of any content you input into the Platform ("Input Content"). By submitting Input Content, you grant us a limited, non-exclusive licence to process it solely for the purpose of delivering the Services to you.

7.5 Output Ownership

Subject to compliance with these Terms, AI Outputs generated from your Input Content are yours to use. We do not claim ownership over your AI Outputs.

8. Intellectual Property

8.1 Platform Ownership

The Platform, including its design, software, trademarks, and underlying technology, is owned by or licensed to fAIk.life and is protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership rights to you.

8.2 Licence to Use

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for your personal or internal business purposes in accordance with these Terms.

8.3 Restrictions

You must not:

  • Copy, reproduce, distribute, or create derivative works from any part of the Platform without our express written consent.
  • Reverse engineer, decompile, or disassemble any part of the Platform.
  • Use the Platform's branding, trademarks, or logos without prior written authorisation.

9. Third-Party Services

The Platform may integrate with or link to third-party services. We are not responsible for the content, availability, or practices of any third-party services. Your use of third-party services is governed by their respective terms and policies.

10. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The Platform will be uninterrupted, error-free, or secure.
  • Any errors or defects will be corrected.
  • The Platform or its servers are free of viruses or harmful components.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, fAIk.life AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM.

Our total aggregate liability to you for any claims arising under or in connection with these Terms shall not exceed the total fees paid by you to us in the 12 months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or personal injury caused by negligence.

12. Indemnification

You agree to indemnify, defend, and hold harmless fAIk.life and its affiliates, officers, directors, and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to:

  • Your use of the Platform in violation of these Terms.
  • Your Input Content.
  • Your violation of any applicable law or third-party rights.

13. Suspension and Termination

13.1 By You

You may cancel your subscription and close your account at any time via your account dashboard or by contacting support@faik.life.

13.2 By Us

We reserve the right to suspend or terminate your access to the Platform at any time, with or without notice, if we believe you have breached these Terms or for any other reason at our reasonable discretion.

13.3 Effect of Termination

Upon termination, your right to access the Platform ceases immediately. We may delete your account data in accordance with our Privacy Policy. Provisions of these Terms that by their nature should survive termination will do so.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of Queensland, Australia. You agree to submit to the exclusive jurisdiction of the courts located in Queensland for the resolution of any disputes arising under these Terms.

Before commencing formal proceedings, you agree to contact us at legal@faik.life to attempt to resolve any dispute informally within 30 days.

15. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes by email or via a notice on the Platform. Your continued use of the Platform after the effective date of updated Terms constitutes your acceptance of the changes.
